(1) The Commission shall recommend to the Government of Nepal the share of investment to be made by the Government of Nepal, provinces and local levels in the mobilization of natural resources based on the following:-
(a) Condition and ability to collect revenue,
(b) Ability to invest,
(c)   share of achievement to be achieved,
(d) share of the enjoyment of the achievement,
(e)   condition and requirement of infrastructure,
(f)   Economic conditions and geographical structure.
(2) According to sub-section (1), the Commission shall determine and recommend to the Government of Nepal the share of returns obtained from the exploitation of natural resources on the basis of the following:-
(a) Location of circulating natural resources,
(b) Areas affected by exploitation of natural resources,
(c)   Dependence on exploited natural resources,
(d)  population benefited by the returns,
(e)   Population dependent on natural resources,
(f) Participation in conservation and sustainable management of natural resources.
